These Terms of Service (“Terms”) govern your access to and use of crownartgallery.com (the “Site”) and the digital art editions, virtual experiences, vouchers, memberships, and related products and services offered by Crown Art Gallery (“Crown Art Gallery,” “we,” “us,” or “our”). By accessing the Site or purchasing any product or service, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Our Products and Services

Crown Art Gallery offers limited-edition digital art reproductions, bespoke digital commissions, virtual exhibition tours, digital monographs, wallpaper suites, blockchain-authenticated (NFT) works, installation blueprints, masterclass content, pattern libraries, audio-visual pieces, and Patron Portal memberships (together, the “Products”). Each Product’s specific description, edition size (where applicable), pricing, and mode of delivery is set out on its individual product page.

2. Eligibility

You must be at least 18 years old to purchase Products or create an account on the Site. By using the Site, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Pricing and Currency

Prices are displayed and may be paid in Nigerian Naira (₦), United States Dollars (US$), or Euros (€), as selected at checkout. Where a price is converted between currencies, the applicable exchange rate is determined by our payment gateway, PayOnUs, at the time of the transaction, and may differ slightly from rates available elsewhere. We reserve the right to correct pricing errors and to update prices at any time; changes will not affect orders already confirmed.

4. Payment

All payments are processed securely through PayOnUs. By making a purchase, you authorize PayOnUs to charge your selected payment method for the applicable amount, including any taxes or fees disclosed at checkout. Crown Art Gallery is not responsible for delays or errors caused by your payment provider, bank, or wallet service.

5. Digital Delivery

Products are delivered digitally, by the method described on each product page — typically a secure download link, a booking or access link, or, for blockchain-authenticated works, a transfer to a wallet address you provide. You are responsible for providing accurate delivery details (including a valid email address or wallet address) at the time of purchase. Crown Art Gallery is not liable for non-delivery resulting from incorrect details provided by you.

6. Intellectual Property and License

Unless otherwise stated on a specific product page, Crown Art Gallery and its artists retain all copyright and intellectual property rights in the artworks, files, and content we sell. Your purchase grants you a personal, non-exclusive, non-transferable license to download, display, and privately enjoy the piece you have acquired. You may not reproduce, redistribute, publicly display for commercial purposes, resell the underlying digital files, or otherwise exploit a Product beyond this personal license, except where a product page expressly grants broader or commercial usage rights (such as the commercial licensing option available on select textile pattern purchases).

For blockchain-authenticated works, ownership of the minted token may be transferred in accordance with the relevant blockchain’s protocol; however, underlying copyright in the artwork is not transferred unless explicitly stated.

7. Edition Integrity and Certificates of Authenticity

Where a Product is sold as a limited edition, we will not exceed the stated edition size, and the edition will not be reissued. Each edition piece is accompanied by a numbered Certificate of Authenticity recording the artist, edition size, and the piece’s position within it. This certificate documents provenance but does not, by itself, constitute a guarantee of future value or resale price.

8. Patron Portal Membership

The Crown Patron Portal is a membership program offering benefits such as seasonal wallpaper suites, private virtual exhibition tours, masterclass access, and exclusive drops, as described on the Patron Portal page. Membership terms, including any recurring fees and how to cancel, will be confirmed at the time of enrollment. We reserve the right to modify Patron Portal benefits from time to time, with reasonable notice to current members.

9. All Sales Are Final

Because our Products are limited-edition, digital, and in many cases bespoke or personalized, all sales are final once a Product has been delivered, access has been granted, or a commission process has begun. We do not offer refunds or exchanges for change of mind, and we encourage you to review each product’s description, edition details, and delivery method carefully before completing your purchase.

That said, we want every collector to receive what they paid for. If you experience a genuine technical issue with delivery — for example, a corrupted file, a failed transfer, or a booking link that does not work — please contact us at support@crownartgallery.com within 7 days of purchase, and we will work with you in good faith to resolve it, which may include re-delivery of the Product.

10. User Conduct

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, other users’ accounts, or our systems.
• Reproduce, redistribute, or exploit our content beyond the license granted in Section 6.
• Interfere with the proper functioning of the Site, including through automated scraping or bot activity.

11. Disclaimers

The Site and Products are provided “as is” and “as available.” To the fullest extent permitted by law, Crown Art Gallery disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or that any digital artwork will appreciate or hold a particular value over time.

12. Limitation of Liability

To the fullest extent permitted by law, Crown Art Gallery’s total liability arising out of or relating to these Terms or your use of the Site and Products shall not exceed the amount you paid for the relevant Product. We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or loss of data, arising from your use of the Site or Products.

13. Indemnification

You agree to indemnify and hold Crown Art Gallery, its curators, and affiliates harmless from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Site or Products.

14. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. Any dispute arising under these Terms shall first be addressed through good-faith negotiation between the parties; if unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts of Nigeria.

15. Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top of this page reflects the most recent version. Continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
